Terms & Conditions

These terms and conditions ("Terms") govern your use and purchases from NayaCo LLC. By placing an order with NayaCo LLC, you express your understanding and agreement that you are bound by these Terms in addition to the Website Terms of Use. If you are unwilling to be bound by these Terms and the NayaCo.com Site Terms of Use, you may not use any of the NayaCo LLC Online Services. These Terms apply to all orders you place with NayaCo LLC using any means of communication.

Payment and Shipment

You may pay for your order using one of the following major credit cards, issued in the United States of America: Visa®, MasterCard®, American Express®, and Discover® cards. Orders placed before 2:00 p.m. Pacific Time, Monday through Friday, will generally be processed, billed, and shipped that day. Orders placed after 2:00 p.m. Pacific Standard time, Monday through Friday, or on weekends, will generally be processed the following business day.

In most cases, your credit card will not be charged if NayaCo LLC declines to accept your order. If your card has been charged, NayaCo LLC will process a refund.

In the event your shipment will be delayed more than thirty (30) days after the date of your order, NayaCo LLC will attempt to notify you by e-mail using the e-mail address you provided, and you may elect to cancel the order. If you elect to cancel the order, NayaCo LLC will issue a refund.

Each of our albums is handcrafted and produced to the highest standards. Due to our rapid growth we have increased the time for promised shipping by 5 business days. This increase was necessary to continue to produce the high quality albums our customers expect.

If your album is not shipped within the 20 business days, NayaCo LLC will refund 10% of the purchase price.

The following restrictions apply:

If your album is not shipped within the 20 business days after the last qualifying event above, NayaCo LLC will refund 10% of the purchase price.

Order Validation and Acceptance

When you place an order with NayaCo LLC, we may verify your method of payment, shipping address and/or tax exempt identification number, if any, before processing your order. Your placement of an order with NayaCo LLC is an offer to purchase our products or services. NayaCo LLC may accept your order by processing your payment and shipping the product or documentation of service, or may for any reason, decline to accept your order or any part of your order. No order shall be considered to be accepted by NayaCo LLC until the product has been shipped. If we decline to accept your order, we will attempt to notify you using the e-mail address you have provided with your order.

Quantity Limitations

NayaCo LLC may limit or cancel quantities available for purchase on any order on any basis, and alter the availability or duration of any special offers at any time. NayaCo LLC may reject any order, or any part of an order. NayaCo LLC may limit or prohibit sales to resellers or dealers.

Electronic Communication

When you place an order with NayaCo LLC, you are required to provide a valid e-mail address, which we may use to communicate with you regarding the status of your order, advise you regarding shipment of backordered products, and to provide you with any other notices, disclosures or other communications relating to your order. You agree that NayaCo LLC will not be responsible for any damage you incur, or information you do not receive, as a result of your failure to provide a valid e-mail address.

Product Display / Colors

NayaCo LLC attempts to display as accurately as possible the colors of the products shown on the Site. However because the colors you see will depend on many factors, including your monitor or printer, NayaCo LLC cannot guarantee that the color you see matches the product color.

Pricing and Product Information

NayaCo LLC makes every effort to provide current and accurate information relating to NayaCo LLC products, services, and prices, but does not guarantee the currency or accuracy of any such information. Information relating to NayaCo LLC products and services is subject to change without notice. Prices are subject to change at any time prior to NayaCo LLC's acceptance of your order. In the event we discover a material error in the description or availability of a product or service that affects your outstanding order with NayaCo LLC, or an error in pricing, we will notify you of the corrected version, and you may choose to accept the corrected version, or cancel the order. If you choose to cancel the order, and your credit card has already been charged for a purchase, NayaCo LLC will issue a credit to your credit card in the amount of the charge.

Sales Tax

NayaCo LLC collects and remits sales taxes as required by law on purchases. If you have tax-exempt status, you must provide a valid tax exempt number evidencing your status at the time of purchase. NayaCo LLC will not refund tax amounts collected in the event a valid number is not provided. If you provide a number that is not accepted for any reason by any governmental or regulatory authority, and NayaCo LLC is required to pay tax on your purchase, you will reimburse NayaCo LLC for the amount of such tax, and NayaCo LLC's reasonable expenses incurred in connection with the payment and collection of such tax.

Warranties

The only warranties NayaCo LLC provides with respect to any product or service purchased with NayaCo LLC are those warranties, if any, set forth in the written NayaCo LLC documentation accompanying such product or service.

Return Policy

You may return any product purchased with NayaCo LLC within thirty (30) days of receipt, provided that the product is unused and unopened. The product must be in its original packaging materials. You must get an RMA from NayaCo LLC Customer Service, before shipping the product back to NayaCo LLC. If you received the wrong product, or a product that is damaged or defective, you may contact NayaCo LLC Customer Service to obtain return instructions and to obtain a replacement.
